Course

Manufacturing is a critical part of the cannabis industry. Cannabis Retailers rely on the cannabis products from manufacturers for their businesses. Record keeping is another important part of the manufacturing process.

Manufacturing companies must keep and maintain records for the entire process including but not limited to:

  • Department issued manufacturing license or licenses.
  • Personnel records, including each employee’s full name, social security, or individual taxpayer identification number, date of beginning employment, clearance and access levels and date of termination of employment if applicable and any other personnel records as required by the state.
  • Records related to employee training including, but are not limited to:
    • the date or dates training occurred,
    • description of the training provided, and
    • the names of your employees that received the training.
  • All supporting documentation for data or information as required by track and trace or seed to sale software manufacturing plans & schedules.
  • Any records evidencing compliance with the environmental protection measures as outlined by the state.
  • Your financial records related to the licensed commercial cannabis activity, including bank statements, tax records, sales invoices, and sales receipts.

You may also need to have contracts with other state licensed cannabis businesses as well as permits, licenses, and other local authorizations to conduct the licensee’s commercial cannabis activity’s accessible from an onsite file management system.

Record Retention

Just like cannabis licensees, manufacturing facilities must keep and maintain their records related to commercial cannabis activity for the time period defined by their state. Typically companies are required by law to maintain records for 5-7 years, even after they close.

The regulatory authorities may examine the books and records as it deems necessary to perform its duties. It is important that records are kept in a manner that allows the records to be produced for the regulatory agencies by the cannabis business in either hard copy or electronic form, whichever the local regulatory agencies requests.

Businesses may choose to contract with a third party to provide custodial or management services of the records but the business is still responsible for the records

All records should be kept in a secure location that can withstand moisture and fire. Most software companies, such as Adilas, provide off site back-up of all remote files to ensure the safety, security and protection of your records.

For those in the industry, you play a critical role in creating a sustainable cannabis industry as it relates to seed to sale tracking. Seed to sale tracking does not actually begin with the seed, it starts with the people.

Here at Adilas420, we feel a great responsibility to ensure quality within of the cannabis industry by carefully considering the connection between the people, profit, and planet

In 2009 an article was published in the Economist titled “The triple bottom line” idea”. What this article reminds us is to be socially, environmentally, and financially responsible. Governing agencies have begun implementing a regulated cannabis industry by requiring screening and tracking of the people and businesses involved with the industry.

While every state or region is different, applications and licensing is commonly required for:

  • Cannabis business owners and investors
  • Employees
  • Vendors
  • Customers
  • Patients

The regulatory agency typically accepts applications from businesses, or sometimes individuals, referred to as “caregivers”, to produce and sell marijuana and marijuana products. The regulatory body establishes a system for accepting and approving or denying licenses.

Different types of cannabis licenses may be available for aspiring business owners ranging from various cultivation sizes, production or manufacturing, distributing, transporting, lab or retailing licenses to name a few.

To make things more complicated, there may be a singular application process, that offers vertically integrated / “all in one” or “micro businesses” licensing or there may be similar but slightly different applications for the various license types.

In the following lessons, typical licensing requirements will be addressed in more detail.

Employees

As part of licensing here In the United States, cannabis business operators and employees will oftentimes be required to get fingerprinted and pass background checks. As is true for any business, an employer will be required to maintain detailed records for their employees.

An employer will need to maintain personnel files including payroll records, training records and other data regarding the employees job responsibilities. Governing agencies may also look closely at records of the different vendors a cannabis company does business with.

A cannabis business may be asked to produce copies of not just their own licenses but the business licenses or approvals to operate for those they do business with. A business will want to track its vendors from seed to sale carefully. This will include vendors for raw materials, medicated products, accessories or any other entity who will be paid by the licensee.

Customers

Customer records may also be scrutinized. For businesses selling cannabis products wholesale, the licensees will be required to record their transaction including attributes common on an invoice such as the purchasers businesses details, type of product, quantity and price.

In some markets, including recreational markets, businesses may not be required to track patient or customer data but will be asked to certify they are verifying the age of customers. Regulators, licensees, employees and customers are the most common people tracked through the seed to sale process.

In the following lessons, you will learn what records regarding the people, the product and the process are typically maintained by the various cannabis businesses licenses. Later on you will learn about reporting requirements including the use of seed to sale and/or Track and Trace software to report not only on your product and process but also on employees, vendors and customers.

Welcome to the introduction to seed to sale tracking for the manufacturing industry.

Hi, I am your trainer, Beth Barber, and I will be taking you through this video training with Adilas420 learning.

A little bit about myself, I have over 15 years experience in industries such as worker safety learning for 10 hour construction training, I built for OSHA, compliance and security as it relates to information technology, a vast banking law compliance, and also building technical policies and procedures that have a proven track record for success. I don’t just teach it, I embody it, and my hope with these videos is to show you the possibilities of seed to sale tracking as it relates to your business goals.

Our goal at Adilas420 is to assist you with your business goals and needs and help you gain a better understanding of:

The cannabis industry as it relates to compliance for local, state, and federal regulations
Safety and security as dictated and addressed by governmental regulations such as OSHA and the EPA

The history of marijuana business has been long and complicated.

Widespread prohibition began world wide in the late 1930’s. Possession of cannabis is still illegal in most countries and yet, it has remained one of the most widely used drugs worldwide. In the last decade, a number of countries, including the United States, have begun to take steps to regulate marijuana sales.

In the US, 29 states, plus the territories of Guam and Puerto Rico, and the District of Columbia allow for medical marijuana as of April 2017. As this industry grows and more states continue to pass laws to legalize it either for recreational or medicinal, more companies will need to have some sort of customer relationship management software to streamline their business processes.

Currently, seventeen other states have more restrictive laws limiting THC content, for the purpose of allowing access to products that are rich in cannabidiol, which is a non-psychoactive component of cannabis.

9 States including Colorado, Washington, Oregon, Alaska, Nevada, Massachusetts, Maine, California and Vermont  have legalized marijuana for recreational adult use. Each state has different requirements for allowing for and  tracking cannabis businesses.

In 2013 Uruguay became the first country to legalize the sale, cultivation, and distribution of cannabis at a federal level.

Canada has also now federally legalized recreational use of marijuana and will require each province to define and implement local regulations.

Regulatory agencies are issuing licensing for cannabis businesses. Business licenses may include cultivation, production and sales facilities.

In the following lessons we will discuss in more detail the common requirements for licensing and facilities.

Local regulatory agencies are also being tasked with the responsibility of ensuring the tracking of cannabis from seed to sale to ensure compliance and consumer safety.

Each jurisdiction will have its own requirements for what is tracked, depending on federal and local rules and regulations.

And while there may be some inconsistencies, the data being collected is valuable information for regulators and businesses alike.

In this lesson I will present an introduction to tracking cannabis business operations including the people, the product and the process, or the “3P’s”, of the cannabis industry. In the following lessons we will discuss in more detail the common requirements for tracking a cannabis through manufacturing, processing, packaging, testing, transporting, sales and distribution.

Taking this course will allow regulators business owners and employees an introduction to best practices to ensure product quality and safety for consumer, employees and our communities. You will also learn more about the tools and technology used to track the 3P’s.

While this course is not meant to train you on how to use any specific software, we will take a quick look at the best options for both track and trace and seed to sale software.

Completing this course will give you a good introduction to what it means to track cannabis from seed to sale.

In the next few videos, you will learn more about tracking the people, the product, and the process.

California Cannabis Labeling Requirements

Labeling Requirements

The Medicinal and Adult-Use Cannabis Regulation and Safety Act (MAUCRSA) included basic requirements for how cannabis and cannabis products must be packaged before sale. These requirements apply to all cannabis flower, pre-rolls and manufactured cannabis products. They do not apply to shipping or transport containers.

In July 2018 the California Department of Public Health, Cannabis Manufacturing Safety Branch released 3 checklists to help cannabis businesses ensure product is labeled compliantly.

Common Packaging and Labeling Questions:

What are the labeling requirements for cannabis and pre-rolls that only contain cannabis?

Cannabis (flower and pre-rolls that only contain flower) must meet the basic requirements outlined in Business & Professions Code - Division 10, Chapter 12. CDPH has not specified any additional requirements for cannabis in the emergency regulations.

Can CDPH provide feedback on my label?

CDPH is not able to review manufacturer’s labels for all of the cannabis products that are sold throughout the state of California.

Can I make the Universal Symbol white or another light color if my packaging is dark?

The Universal Symbol must be black. It cannot be modified, other than resizing, and the color cannot be changed from black. The symbol must be visible on your label. If your packaging is dark, you can use a lighter background color on your label where the symbol will be placed or you can outline the symbol using a contrasting color.

Which products require opaque packaging?

Only edible cannabis products are required to be in opaque packaging. Edibles are products similar to traditional food products, such as cakes, cookies, beverages and juices, tea and coffee, chocolates, gummies, gum and mints.

The California Department of Public Health’s Manufactured Cannabis Safety Branch (MCSB) is one of three state cannabis authorities charged with licensing and regulating commercial cannabis activity in California. What will Arizona Medical Marijuana Dispensaries do regarding the sales of extracts?

Arizona’s 2010 medical marijuana law does not include extracts of marijuana — dubbed “hashish”, the appellate court ruled. This decision impacts Arizona Medical Marijuana Dispensaries in more than one way.

This week, the Arizona Appeals Court ruled that The Arizona Medical Marijuana Act in no way immunizes the possession or use of hashish. “Hashish” (cannabis oil or resins). What does this mean for Arizona medical marijuana dispensaries?

The Arizona Department of Health Services (AZDHS) had previously allowed concentrate sales, and numerous large-scale commercial kitchens and extract manufacturers are operating statewide to supply more than 100 dispensaries.

Both the rules and interpretation of them have been muddied by poor cannabis vocabulary.

AZDHS has tracked three types of cannabis products over the last 7 years:

marijuana,

marijuana edibles and

marijuana other. 

 

Dispensaries are now struggling to figure out, what other products, besides marijuana can be sold.

The Act defines marijuana as the flower of cannabis, not including root balls, sticks, stems or leaves. The court has ruled that it also does not included hashish, which is the extracted oils produced by cannabis.

Since the Act does not acknowledge the significance of various cannabis compounds, such as cannabinoids: CBD or THC, this would appear to include CBD oils commonly used by medical patients pursuing medicinal relief without any psychoactive effects.

The decision was offered as a result of the appeal of a 24 year old Arizona Patient who was found guilty of possessing his medication, purchased from an Arizona State License Dispensary and within the allowed amount of marijuana in compliance with the Act. He was sentenced to two years in prison for the cannabis oil and another year for possession of paraphernalia (the tool used to consume his medicine).

AZ Court Ruling on Concentrates

This ruling should invoke fear in all patients in Arizona consuming edibles, made from cannabis oil and various other forms of administration including vape oils, syringe applicators, tinctures, topical and edibles.

The Dispensary’s will likely be required to seize operations for and sales of marijuana products produced with extract including edibles and other marijuana.

It has hard to predict the total impact on sales, but this will likely at least mean hundreds of jobs lost and that many patients, unable or unwilling to smoke marijuana flower will be out of medicine.

A May 2018 report by AZDHS shows that edibles and product other than marijuana flower made up for 62,783 ounces of the 727,969.65 ounces sold.

We would expect Arizona’s Dispensary Owners and Patients to rally to fight this gross and pointless interpretation. After 8 years of planning, operating, selling and consuming cannabis extracts, Arizona will feel the pain of this unjust prohibition.

This has caused a delay in Recreational Marijuana Sales in Massachusetts.

Testing is a critical part of the cannabis supply chain.

There are great challenges in operating a Testing Laboratory and being able to demonstrate compliance with Lab Standards like those offered by ISO17025. It can also be difficult, though not impossible, to make a Lab profitable as a small business.

Hopefully, one of Mass’s many brilliant science geeks will step up for an entrepreneurial challenge and opportunity, so that recreational marijuana sales in Massachusetts can begin soon!

California cannabis must meet higher standards by July 1st

July 1, 2018 represents Phase 2 of implementing compliance expectations for California Cannabis Businesses.

As of January 1, the state’s emergency regulations require temporary licensees to document all sales and transfers of cannabis and cannabis products between temporary licensees—or between temporary licensees and annual licensees—by manually using paper sales invoices or shipping manifests. All annual licensees are required to use METRC Track and Trace Software.  

July 1 represents another big step in implementing the progressing regulations from seed to sale in California.

While the state previously mandated testing on all products, a transitional period has been allowed. This has allowed cultivation, manufacturing and distribution companies to adjust operational procedures.

In addition to testing for cannabinoid profiles, and a few specific impurities as required as of January 1, Cannabis Testing Laboratories will go from testing for 21 pesticides to 66 pesticides. Vendors caught with product that’s non-compliant after the July 1 deadline could face a fine and other penalties for a violation.

 

Also, July 1 marks the date for new requirements for cannabis retail businesses.

Packaging will have to include the product’s potency, where the product came from, and what other ingredients are found in it.

Marijuana retailers across the state will be forced to sell their cannabis products at a discount ahead of the July 1 deadline that will require products meet new state regulations.

METRC

As described on METRC's website:

" Metrc® is a regulatory compliance management solution used as a tool by government regulatory bodies for the oversight and compliance management of recreational and medical marijuana programs. Metrc is an online soft-ware reporting system for use by legally state licensed producers, processors, wholesalers, labs, dispensaries, and retail establishments to manage and report all supply chain activities (ex: inventories, sales, transfer manifesting, testing, etc.) and other aspects of their marijuana business, as required by state rules or regulations."

Adilas is now a valid integrator for METRC track and trace software in California

As you may know California has selected Metrc as the state’s track-and-trace system to track commercial cannabis activity and movement across the distribution chain (“seed-to-sale”). This site is intended to give annual licensees information that will help them use Metrc to remain in compliance with California’s tracking and reporting requirements. Adilas is now a valid integrator for METRC track and trace software in California.

For information on California’s programs – including regulatory requirements – visit the following websites:

  • Bureau of Cannabis Control – a bureau within the California Department of Consumer Affairs, BCC is responsible for licensing retailers, distributors, testing laboratories and microbusinesses.

  • CalCannabis Cultivation Licensing – a division within the California Department of Food & Agriculture, CalCannabis is responsible for licensing cultivators (including nurseries and processors) and implementing the state’s Track-and-Trace system to record movement of cannabis from seed to sale.

  • Manufactured Cannabis Safety Branch – a branch within the California Department of Public Health, MCSB is responsible for licensing manufacturers of cannabis products. This includes nearly all non-flower products (edibles, concentrate, tinctures, etc.).

Here is how it works:

Franwell will be providing web based training classes for prospective annual licensees. To sign-up for training, please click the “Schedule Training Now” link below and enter in a valid application number to get started :

NOTE: Only applicants who have submitted an application(s) for an annual license may register for this training, and the Application Number (or other identifier) is required to register.

​After these steps are complete, Franwell will issue a vendor API key.

Once you have an API Key:

  • From your Adilas Dispensary Homepage, click on “More Options” and click on the link “3rd party solutions”.
  • Scroll down the page until you see the  Metrc logo.
  • Switch the Authorization field from “No Thanks – Keep this door closed” to “Yes – I want to open this door!”
  • Paste in the new API key that Metrc gave you into the field labeled “Metrc User API Key”.
  • Type in your license number into the field labeled “License Number”.
  • Select “CA” from the “State” field.
  • Select “Transactional (live, each invoice as created)” from the Sales Reporting Connection Type pulldown menu.
  • Click the “Save Settings” button.
  • Your Adilas system is now connected to Metrc.

California and Metrc will continue to roll out functionality and specifics of how they want to report in the coming months.
