Medical Marijuana in Virginia

***Industry News: Botanical products may now be dispensed to patients**

On March 9, 2018 Gov. Ralph Northam signed HB 1251, which allows doctors to recommend CBD or THC-A cannabis oil for any condition. Virginia processors will cultivate medical marijuana plants under strict controls. With a state issued license and the appropriate software, companies are able to dispense cannabis oil to patients who have a diagnosed condition with a doctor’s recommendation.

Who Oversees the Medical Marijuana Program?

The Virginia Department of Health Professions Board of Pharmacy division oversees the medical marijuana program. The Virginia Board of Pharmacy has selected one medical marijuana provider for each of the state’s five health service areas. The department is not currently accepting applications for medical establishments. However, the department is issuing licenses for recreational establishments.

Virginia Medical Sale Restrictions:

Virginia sales restrictions have been defined by the Cannabis Control Authority as the following:

  1. cannabis flower allows for up to 4 ounces per 30 days to be dispensed to a patient.
  2. Patients who purchase cannabis oil products are allowed a 90-day supply. Such products, as defined under the law, must contain per dose a minimum of 5 mg of CBD or THC-A and may contain up to 10 mg of THC. Products permitted under the law may be in any formulation, including inhalable, edible, and topical preparations.
  3. Possession of up to an ounce of marijuana is legal for people 21 and older. This began July 1, 2021. Adults caught with more than an ounce but less than a pound will face a $25 fine.
