Adult Use Marijuana in OH
Ohio legalized adult-use (recreational) cannabis in November 2023 through the passage of Issue 2. Adult-use sales officially launched in select dual-use dispensaries on June 19, 2025. The Division of Cannabis Control (DCC), under the Department of Commerce, is responsible for overseeing the adult-use cannabis program, including licensing, compliance, and reporting requirements. The law permits adults aged 21 and over to purchase up to 2.5 ounces of cannabis or 15 grams of extract, and allows home cultivation of up to six plants per adult, with a maximum of 12 per household. Similar to the medical program, adult-use cannabis operations are tracked from seed to sale using the state's mandated inventory tracking system, ensuring product safety, tax compliance, and regulatory transparency.
Medical Marijuana in OH
Ohio legalized medical marijuana in 2016 through House Bill 523, establishing the Ohio Medical Marijuana Control Program (MMCP). The program permits qualified patients with approved medical conditions to access a variety of cannabis products, including oils, tinctures, edibles, patches, and plant material for vaporization. While smoking cannabis is prohibited, vaporizing dried flower is allowed. The MMCP oversees the cultivation, processing, testing, and dispensing of medical marijuana, requiring all licensees to comply with strict seed-to-sale tracking and reporting protocols. Three agencies share regulatory authority: the Department of Commerce oversees cultivators, processors, and testing labs; the State of Ohio Board of Pharmacy regulates dispensaries and patient/caregiver registration; and the State Medical Board certifies physicians who recommend medical marijuana.
