Ohio legalized cannabis through House Bill 253 in 2016. Ohio’s Medical Marijuana Program allows for multiple types of cannabis products including tinctures, oils, patches, plant material, oils and edibles, although the law prohibits flower intended for the use of smoking, vaping is allowed. As of August 2021, there were over 209,000 registered medical marijuana patients in Ohio.

Who oversees the Medical Marijuana Control Program in Ohio?

Three state agencies regulate and oversee different aspects of the program.

The Ohio department of Congress will oversee the Medical Marijuana Control Program (MMCP) licensing of facilities including cultivation, processing, and testing labs. The program has approved 20 “Level I” licenses. Of which, 15 have received Approvals to Operate. The program has also approved 14 “Level II” licenses. Of which, 12 have received Approvals to Operate.

The State of Ohio Board and Pharmacy is responsible for cannabis retail dispensaries, patient and caregiver registration, and approving new forms of marijuana for use.

The State Medical Board of Ohio is responsible for certifying qualified physicians to prescribe medical cannabis and may add to the list of qualifying conditions which qualify for a medical cannabis card.
