Delaware Recreational Marijuana

On April 21, 2023, HB 1 and HB 2 (the Marijuana Control Act), became law without Governor John Carney’s signature. The legislature passed both bills with supermajority votes. Delaware is now the 22nd state to legalize marijuana for recreational purposes.

Who Oversees the Delaware Rec Program

The Department of Safety and Homeland Security (DSHS) will work in partnership with the Department of Health and Social Services (DHSS) to implement these bills. They will Create the framework for the seed to sale of legal recreational marijuana in Delaware. The State anticipates that licensure applications will be available by May 2024. Each medical facility in Delaware must register with the department, file for licensing, and implement a seed to sale tracking system for state reporting. Rigorous inspection of the regulated vendors minimizes the risk to human health and environmental impact within the industry.
