Arizona Medical Marijuana Program

Arizona voters approved medical marijuana program through a ballot initiative in 2010. The passing of Proposition 203 (the Arizona Medical Marijuana Act (AMMA), A.R.S. §36-2801 et seq) made Arizona the fifteenth state to legalize medical marijuana. The AMMA went into effect on April 14, 2011. Several updates to these rules have gone into effect. The latest update includes mandated testing for all medicated products.

Who Oversees the AZ Marijuana Program?

The Arizona Department of Health Services (ADHS) regulates the patient and caregiver registry and purchasing limitations. Medical Marijuana Organizations are non-profit entities therefore are not regulated by any other agency.

What To Know About Compliance

The Arizona Revised Statutes (A.R.S.) represent the statutory laws of the state of Arizona. The A.R.S. and the Arizona Medical Marijuana Rules each contain requirements applicable to the Arizona Medical Marijuana Program. The A.R.S. and the Arizona Medical Marijuana Rules should be read in conjunction with each other, in order to fully understand requirements of Arizona marijuana businesses. There are resources to help interpret these rules and regulations and can ensure the business is operating in a compliant manner.

The Arizona MMJ Market

Arizona currently has over 313,000 registered patients and one of the fastest growing medical cannabis markets in the country. ADHS has issued 143 marijuana business licenses (Arizona Medical Marijuana Program August 2021 Monthly Report, 2021). Arizona licenses are vertically integrated (meaning once issued a license, the business owner can seek approvals to operate for a dispensary, cultivation and manufacturing facilities). A facility may be registered as a medical or recreational establishment or a combination of the two. This ensures businesses can cater to the market population.
