Adult Use Marijuana in Maryland

Beginning on July 1, 2023, adults 21 or older may possess and consume cannabis for adult use in Maryland. The law also establishes a process for expunging cases in which possession of less than 10 grams of cannabis is the only charge. In addition, it will create three new funds which address public health related to Adult Use Marijuana in Maryland, a social equity fund for small, minority, and women-owned businesses in the cannabis industry and funding for communities disproportionately impacted by cannabis prohibition and enforcement.

Who Oversees the Adult Use Program

During the 2023 legislative session, the Maryland General Assembly will consider a regulatory framework for the adult use market. The General Assembly will also establish the date on which legal adult-use cannabis sales may begin in Maryland. Thus, the Maryland Medical Cannabis Commission will provide more information as it becomes available.

Maryland Adult Use Sale Restrictions

According to the new law, adults 21 or older may possess and consume the states “personal use amount”. The person use amount is up to 1.5 ounces of cannabis flower, 12 grams of concentrated cannabis, or cannabis products that do not exceed 750 mg THC total. The regulation of marijuana sales has defined purchase limitations for consumers. These limitations are outlined in the Maryland Dispensary Standard Operating Procedures.
