HB2312 and SB1406 were introduced by Governor Northam and passed by the 2021 General Assembly. These statutes prioritize social equity, public health and public safety. The bills also lay out a three year process to legalize cannabis and create a regulatory framework for the sale of the product.
On January 1, 2024, assuming reenactment, legal sales to adults 21 and older can begin.

On March 9, 2018 Gov. Ralph Northam signed HB 1251, which allows doctors can recommend CBD or THC-A cannabis oil for any condition.
The Virginia Board of Pharmacy has selected one medical marijuana provider for each of the state's five health service areas.
