In 2018 Oklahoma legalized medical marijuana. The Governor approved emergency Rules for SQ 788  and signed it on 8/6/18 making the rules effective as of this date. These emergency rules are constantly being updated to help ensure patient safety and the responsible use of medical cannabis. Oklahoma’s Medical Marijuana program is continuously growing. The number of businesses has increased by 139% from 2020 to 2021 which was warranted given the increase in patients by over 30,000 over the same period of time.

Who oversees the Medical Cannabis Program in Oklahoma?

The Oklahoma Medical Marijuana Authority (OMMA) was established to oversee the medical marijuana program for the State of Oklahoma. It is responsible for licensing, regulating, and administering the program as authorized by 20.

Sales Restrictions

Oklahoma qualified patients are restricted to three ounces of marijuana, one ounce of marijuana concentrate, seventy-two ounces of edible medical marijuana products, six mature plants, and/or six (6) seedling plants per transaction. These sales must be tracked and reported to the OMMA on a monthly basis until METRC is fully implemented.

The Oklahoma Medical Marijuana Authority

The Oklahoma Medical Marijuana Authority (OMMA) was established in 2018 to regulate and oversee the MMJ market in Oklahoma. In accordance with their mission of providing safe product to patients, the OMMA has mandated the use of Seed to Sale software for Marijuana businesses across the state of Oklahoma. The OMMA currently allows out of state patients with current patient cards to possess “Temporary Adult Patient Licenses”. The agency also partners with the Department of Agriculture Licensing for the oversight of commercial licenses, the Oklahoma Tax Commission who regulated sales tax permits for dispensaries, and the Oklahoma Bureau of Narcotics and Dangerous Drugs Control for oversight of grower, processor, and dispensary applications.
